AtData, LLC (“AtData,” “we” or “us”) provides this privacy policy (the “Privacy Policy”) to describe how we collect, use and share information we access in the course of providing our services, including information collected through atdata.com (the “Site”), received from third parties, and collected through AtData technologies (collectively, the “Services”).

Information Collection

When using our Site, you may voluntarily provide information about yourself, including name, contact information, login information, and any other information you choose to provide. For example, we collect this information when you join our mailing list, create an account, complete a survey, request information, or interact with use for any other purpose. We may also collect credit card or payment information when you place an order with us.

We automatically collect information related to your interactions with us and our Services or other websites or apps, including browser type, email opens, IP address, pages visited and other activities on websites, device type, and other information we collect through the use of cookies and similar technology.

To provide our Services, we receive information from various companies and sources that collect and supply consumer data, including public sources and our marketing partners. From these sources, we may collect name, mailing address, unique identifiers, telephone number, or email address.

Information Use

We use the information we collect for any lawful purposes, including to do the following:

Create and manage your user account.
Provide our Services.
Respond to and communicate with you, including to respond to your inquiries.
Send you updates, promotions, and marketing materials that may be of interest to you.
Operate, personalize, and improve our Site and Services.
For analytics, market research and product development purposes.
Maintain the security of our Site and Services, including fraud prevention services.
Comply with the law and our policies and procedures, including the enforcement of our Terms and Conditions.
Create, improve, and deliver the Services to our customers through data services products that assist them in marketing to their own customers and prospective customers including through email, direct mail or display media and measuring the effectiveness of campaigns.
Combine, link, or aggregate the information we collect to provide our Services, including by linking a unique identifier based on a website visit with other information about a consumer, sometimes called “identity resolution,” to deliver cross-context advertising over the Internet, another device, or email or direct mail promotions.
Providing and supporting related data services, such as information verification and data hygiene, anti-fraud, and other analytics and database tools.

Information Sharing

We may share the information we collect with other parties, including as follows:

Service providers, such as credit card processors, who help us deliver the services you request or we provide.
With customers, marketing partners, marketing services, and platforms to provide our Services.
With affiliated or subsidiary companies.
If we or all or substantially all of our assets, are purchased by another company (such as in a merger, consolidation, restructuring, the sale of stock and/or assets, or other corporate change or financing transaction, including a bankruptcy proceeding), the information in our possession will likely be transferred to the successor entity. We also may share the information during the course of any due diligence process.
If we believe that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas, warrants, or law enforcement and government agency requests provided to us; or (b) to protect or otherwise defend the rights, property or safety of AtData or any other party.

We may share information that has been de-identified or aggregated without limitation.

Data Retention

We retain the data that we control for as long as is necessary or appropriate to fulfill the purpose for which the data was collected as described in this Privacy Policy.

Digital Advertising & Analytics

To assist in marketing of AtData’s services, we may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of AtData on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

If you browse the web from multiple browsers or devices, you will need to opt out from each browser and/or device. Similarly, if you use a new device, change browsers or delete all of your cookies, you need to exercise your choices again. Note that electing to opt out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests.

We may also work with third parties that collect data about your use of the Site and other sites or apps over time for non-advertising purposes. AtData uses Google Analytics and other third-party services to improve the performance of the Site and for analytics and marketing purposes. Your Choices

To opt out of our email marketing, you can use the link provided at the bottom of each marketing message. If you opt out of our email marketing, we will still send you messages related to our transactions and relationship with you, such as order confirmations.

You also may request access to the personal data that we hold about you. If you wish to make such a request, please visit our Privacy Portal page here. When you make such a request, we will request that you reasonably verify your identity.

For AtData customers, when you have an account with us, you may review, change, or update your account information by logging into your account.

The Site may provide links to third-party websites. AtData is not responsible for the privacy practices of these other sites or companies. You should review the privacy policies of other websites or apps that you use to learn about their data practices.

State Privacy Notice

Under California, Colorado, Connecticut, Nevada, Utah, and Virginia privacy laws, AtData is required to inform residents about the categories of personal data we collect about you, the purposes for which we use this information, and with whom such information may be shared. For information about exercising rights under relevant laws, please refer to the “Your Rights” section below.

We do not knowingly collect personal data from minors under 16 years of age.

AtData does not collect sensitive personal data, as that term is defined under certain U.S. state privacy laws.

Purposes for Processing Personal Data. We use and disclose the personal data we collect for our commercial and business purposes, as further described above in the “Information Use” section of this Privacy Policy.

Disclosure of Personal Data. We disclose the categories of personal data we collect to the categories of third parties listed in the “Information Sharing” section of this Privacy Policy for commercial and business purposes.

Annual User Rights Request Metrics

The CCPA requires certain businesses to compile and disclose metrics on an annual basis regarding their compliance with the CCPA and consumer rights requests. The metrics must be posted by July 1 of each year. AtData has elected to report the required metrics on a calendar year basis for the period of January 1, 2023 through December 31, 2023. During the previous calendar year, AtData facilitated the following requests from California residents who submitted requests via our online portal, by phone or mail:

European Economic Area, Switzerland, and United Kingdom Visitors

This section applies to individuals from the European Economic Area, Switzerland, or the United Kingdom. For information about exercising rights under relevant laws, please refer to the “Your Rights” section below.

We may collect and process personal data about you where the laws of your jurisdiction permit it. We may rely on the following legal bases to process personal data about you:

Contract: It is necessary to process personal data about you to perform a contract with you or because you have requested we do something before creating a contract with you that requires we process personal data about you.
Legitimate Interest: There is a commercial or business interest that is important to us or others which we’ve balanced against your privacy rights. For example, we may process data collected through our Site for security purposes.
Consent: You have given your permission to use personal data about you. For example, you may provide your consent to certain marketing activities.
Legal Obligation: It is necessary to use personal data about you so that we can fulfil our legal and regulatory obligations, for example, to honor your legal rights or the rights of others.

Please be aware that the personal data we collect may be transferred to and maintained on servers or databases located outside your jurisdiction.

When transferring personal data to the U.S., AtData, and our subsidiary XVerify LLC, comply with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. AtData has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. AtData has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.

If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Your Rights

You have rights with respect to the personal data collected by AtData, subject to certain jurisdiction specific requirements and subject to certain exceptions and limitations.

Right to confirm whether we are processing personal data about you as a controller.
Right to know the categories and specific pieces of personal data that we collect, use, or sell about you; the categories of sources from which we collected personal data about you; our purposes for collecting or selling personal data about you; the categories of personal data about you that we have sold or disclosed for a business purpose; and the categories of third parties with which we have shared personal data.
Right to receive a portable and readily usable copy of the personal data we have collected about you, to the extent feasible.
Right to correct inaccuracies in the personal data we have collected about you.
Right to request deletion of personal data we have collected about you.
Right to opt-out of (i) the sharing of personal data for targeted advertising or cross-context behavioral advertising; (ii) the sale of personal data; or (iii) profiling for decisions that have significant effects. Please note that if you opt out of certain practices, we may be unable to provide you with some services. Additionally, we do not knowingly sell or share personal data of individuals under 16.
Right to restrict or object to processing of personal data in certain circumstances.
Right to withdraw consent you previously provided to processing personal data.
Right to nondiscrimination for the exercise of the above privacy rights.

If you are not satisfied with our response to your request, we hope you will reach out to us first at [email protected]. For residents of the EEA or the UK, if you are still unhappy, you have the right to complain to your Data Protection Authority. Additionally, if you have submitted a request that we have not reasonably fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to [email protected].

Verification Process and Required Information. We may need to request additional information from you to verify your identity or understand the scope of your request. We will require you to provide, at a minimum, your full name and email address.

Authorized Agents. Depending on your jurisdiction, you may also designate an agent to make requests to exercise your rights. We will take steps both to verify the identity of the person seeking to exercise their rights as listed above, and to verify that your agent has been authorized to make a request on your behalf by providing us with a signed written authorization or a copy of a power of attorney.
