On July 1, 2024, the California Legislature passed two bills that significantly reform and amend the Private Attorneys General Act of 2004 (“PAGA”)—collectively, “PAGA Reform.” Many of the amendments take effect immediately, though a few revisions take effect on October 1, 2024. These changes apply to PAGA actions filed on or after June 19, 2024, as well as PAGA notices submitted to the Labor Workforce Development Agency (“LWDA”) on or after that date. 𝗪𝗵𝘆 𝗛𝗲𝗮𝗱𝗶𝗻𝗴𝘀 𝗠𝗮𝘁𝘁𝗲𝗿 𝗶𝗻 𝗔𝗽𝗽𝗲𝗹𝗹𝗮𝘁𝗲 𝗕𝗿𝗶𝗲𝗳𝘀 Under California appellate rules, briefs must state each point under a separate heading or subheading.  Appellants and respondents alike should heed this requirement, as both persuasion and preservation may depend on it.  Some practice tips to consider: ✅ Many appellate courts will deem an argument forfeited if buried under an unrelated heading, or made only in a footnote. ✅ Headings should be substantive, but not so lengthy that they cease to serve as "headlines" and start to resemble text. ✅ Organizing headings for each distinct contention brings discipline to the drafting process, making the brief more coherent and digestible.  Generating a new Table of Contents for each draft is an excellent editing tool, helping you see whether points flow logically and persuasively. ✅ If the Table of Contents has "gaps" that would confuse a stranger, revise.  Justices often read the TOC to gain a substantive overview of the brief before diving in.   ► 𝗧𝗵𝗲 𝗽𝗿𝗮𝗰𝘁𝗶𝗰𝗮𝗹 𝗺𝗲𝘀𝘀𝗮𝗴𝗲:  Ensure that your brief headings are crisp and clear, and that they smoothly outline all your core contentions on appeal. #appeals Laurie Hepler

On July 15, 2024, California Assembly Bill No. 2049 was signed, which changes the rules for summary judgment motions in state court effective January 1, 2025. There are a number of deadline changes associated with this bill. The changes adjust deadlines by six days:  📌Summary Judgment and Summary Adjudication motions must be filed 81 days before the hearing date, plus time for service, not 75 days as provided by current law (Code of Civil Procedure § 437c.)  📌Opposition papers are now due 20 days before the hearing, instead of 14 days as provided by current law. 📌Reply papers are now due 11 days before the hearing, not five days as provided by current law. Additional, non-deadline changes of note in AB 2049 include a narrow expansion of the opportunity to seek summary adjudication of issues (i.e. partial summary judgment). Under current law, a motion for summary adjudication may only be filed if it completely disposes of a cause of action, an affirmative defense, a claim or damages, such as punitive damages or an issue of duty. The amendment will allow summary adjudication of legal issues that do not completely dispose of a cause of action, affirmative defense, or duty issue, but only if the affected parties stipulate that the motion would further judicial economy, and if the trial court agrees to allow filing.  For more information see: https://lnkd.in/gVhBGpfM

Shorthand court reporters: sunset: certification. • Existing law entitles a person to obtain a certificate as a certified shorthand reporter if certain requirements are met, including passing a specified exam." • This bill requires the California state licensing examination to consist of three divisible parts, including English, Professional Practice, and Dictation/Transcription (Machine/Skill)... • The bill would require an applicant to take and pass all three parts of the examination within 3 consecutive years and authorize an applicant to repeat any part of the examination... • Existing law states that a natural person holding a valid certificate as a shorthand reporter is known as a 'certified shorthand reporter.' • This bill would add the phrase 'voice writer' to the above-described list of words and phrases. If a reporter states a license number not within these ranges, they are most likely not a California-certified stenographic reporter.
