On the EU AI Act... 'Once the standards are set they will preclude others from demanding more. The processes are not entirely transparent and there is a question as to where civil society and individuals can affect these standards'. Paraphrasing a key point from an excellent talk today in the AI Lund series by Eduardo Gill-Pedro. Professor Gill-Pedro talked about the functioning of fundamental rights impact assessments in the Act, raising this above point that is key to understanding the role of the Act on democracy and politics in Europe and beyond.

In part one of this series (see below for link), we talked about the general approach by the Law Society of Ontario (LSO) to lawyers’ use of generative artificial intelligence (AI). We noted that the LSO has broad expectations around competence, confidentiality, bias and transparency. But, of course, it goes well beyond that. As an Ontario lawyer, you will also know that the LSO has its Rules of Professional Conduct, which mandate compliance with certain detailed expectations. These target the various aspects of the daily work performed by lawyers, and those to whom they may delegate certain tasks.

The First International Treaty on Artificial Intelligence. Adopted by the Council of Europe on May 17, 2024. This is the First ever legally binding treaty for AI systems. This first-ever legally binding treaty for AI systems to protect human rights, the rule of law, and democracy. The US, UK, and EU have signed the world’s first binding AI treaty: the Council of Europe’s Framework Convention on AI, Human Rights, Democracy, and the Rule of Law. This agreement ensures AI development and use in both public and private sectors follow principles of transparency, human rights, democracy, and the rule of law. Signatories must assess and mitigate AI's negative impacts and provide remedies for violations of fundamental rights. They will need to determine whether new legislation is needed or if existing laws, such as human rights law, are sufficient.
